Terms and Conditions – Fondo Oro SHOP

This is an English translation for convenience. In case of any discrepancy, the German AGB shall prevail.‍ ‍

1. Scope, Seller

  1. These Terms apply to all orders placed through the Fondo Oro Magazine online shop at fondo-oro.art/shop.

2. Conclusion of Contract

  1. The display of items in the shop does not constitute a binding offer, but an invitation to order.

  2. By completing the order process, the customer submits a binding offer to purchase.

  3. A contract is formed once we accept the order by order confirmation email or by shipping the goods.

3. Products Offered

  1. The shop primarily offers used and antiquarian items (including vintage postcards, monographs, and catalogues), and may in future offer posters and other merchandise related to gold-ground panel painting.

  2. The condition of used/antiquarian items is described to the best of our knowledge in the item description. Ordinary wear consistent with age and storage does not constitute a defect unless the item is expressly described as free of such wear. For one-of-a-kind items, no replacement can be provided; the customer's remedy in that case is limited to a refund.

4. Prices and Shipping Costs

  1. All prices include statutory German VAT.

  2. Shipping costs apply in addition and are shown before the order is completed.

5. Payment

Payment is processed via Squarespace Payments, using Stripe as payment service provider. The payment methods shown during checkout are binding.

6. Delivery and Shipping

  1. Shipping is carried out exclusively via DHL, within Germany and worldwide.

  2. Stated delivery times are non-binding estimates.

  3. For deliveries outside the European Union, additional customs duties, taxes, or fees may apply in the destination country. These are borne by the customer and are not included in our prices.

  4. For orders placed by consumers, risk of accidental loss or damage passes only upon delivery of the goods to the customer.

7. Retention of Title

Delivered goods remain the property of the seller until paid in full.

8. Warranty

Statutory warranty rights apply. For consumers, the statutory limitation period of two years from delivery applies in full, including for used/antiquarian items.

9. Liability

We are liable without limitation for intent and gross negligence, and under the German Product Liability Act. For slight negligence, we are liable only for breach of a material contractual obligation, limited to foreseeable, typical damage. Liability for slight negligence is otherwise excluded. These limitations do not apply to injury to life, body, or health.

10. Right of Withdrawal

Consumers have a statutory right of withdrawal. See the separate withdrawal policy and model withdrawal form at fondo-oro.art/widerruf.

11. Dispute Resolution

We are not willing and not obligated to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

  1. These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent it does not deprive them of protections under mandatory provisions of the law of their habitual residence.

  2. Should any provision of these Terms be invalid, the remaining provisions remain unaffected. Last updated: August 2026
