1. Scope and Contracting Party
These Terms and Conditions apply to all purchases made in the Fondo Oro Magazine Shop at fondo-oro.art/shop.

2. Conclusion of Contract
The product listings in the Shop are not a binding offer, but an invitation for you to place an order. By submitting an order and completing checkout, you make a binding offer to purchase the listed item(s). We accept your offer either by sending an order confirmation by email, or by shipping the goods — whichever occurs first.
3. Prices and Shipping Costs
All prices shown include statutory German VAT. Shipping costs are shown separately at checkout before you complete your order and depend on the delivery destination.
4. Payment
Payment is processed via Squarespace Payments and/or Stripe, using the payment methods offered at checkout. Payment is due at the time of ordering.
5. Delivery
We ship within Germany and internationally, exclusively via DHL. Estimated delivery times are shown in the Shop and are non-binding unless expressly confirmed as a fixed date.
For deliveries outside the European Union, additional customs duties, import taxes, or fees may apply on arrival. These are the responsibility of the recipient and are not included in the purchase price or shipping cost.
6. Retention of Title
The delivered goods remain our property until payment has been received in full.
7. Nature of the Goods — Used and Antiquarian Items
Our range includes vintage postcards and used/antiquarian books, monographs, and catalogues, alongside newly produced items such as prints or posters. Where an item is used, vintage, or antiquarian, its condition is described in the product listing to the best of our knowledge; minor signs of age or wear typical for such items (e.g. foxing, a worn spine, or a previous owner's mark) do not constitute a defect unless the listing states the item to be in a different condition.
8. Warranty
Statutory warranty rights (liability for defects) apply. For used goods, and where you are a consumer, we may agree with you on a shortened limitation period of one year from delivery, instead of the statutory two years, in accordance with § 476(2) BGB; where no such shortened period is separately agreed, the statutory period applies.
9. Right of Withdrawal
As a consumer, you have a statutory right of withdrawal. Details are set out in our separate Right of Withdrawal / Cancellation Policy.
10. Dispute Resolution
We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) and do not currently do so voluntarily.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Where you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence.
12. Final Provisions
